Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://devixpert.com (the "Site") and any strategy call, proposal, or engagement you begin with DeviXpert ("DeviXpert", "we", "us", or "our") as a result. By using the Site or submitting a strategy call request, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who We Are
DeviXpert is an AI-driven digital marketing and automation agency serving businesses in USA & Canada and beyond, offering services including SEO, GEO (Generative Engine Optimization), web design & development, paid media, social media, PPC, AI workflows & automation, and graphic design.
2. Use of the Site
You may browse the Site and submit inquiries for lawful purposes only. You agree not to: misuse the Site or its lead-capture forms (including submitting false contact information or automated/bulk submissions); attempt to gain unauthorized access to the Site, its underlying code, or any non-public systems; or interfere with the Site's normal operation, security, or availability.
3. Strategy Calls, Proposals & Engagements
Submitting a "Book a Free Strategy Call" request, using the pricing calculator on a service page, or otherwise contacting us does not, by itself, create a binding contract or purchase obligation on either side. Any figures shown by an on-site calculator or discussed on an initial call are starting estimates only, not a binding quote — final scope, deliverables, timelines, and pricing for any actual engagement are set out in a separate written proposal or service agreement, which governs that engagement and takes precedence over anything stated on the Site if the two conflict.
4. Fees & Payment
Fees, payment schedules, and invoicing terms for a specific engagement are set out in that engagement's proposal or service agreement, not on this Site. Unless that agreement states otherwise, fees already paid for work performed are non-refundable, and we reserve the right to pause or terminate work on an engagement if payment is materially overdue.
5. No Guaranteed Results
Search rankings, AI-answer visibility, ad performance, traffic, leads, and other marketing outcomes depend on factors outside our control — including third-party platform algorithms (e.g. Google, Meta, AI search engines), competitor activity, and market conditions. We do not guarantee specific rankings, traffic levels, lead volume, return on ad spend, or any other outcome from our services, and any figures discussed (including on-site estimates such as the ROI or website pricing calculators) are illustrative only, not a promise of results.
6. Intellectual Property
The Site's design, code, copy, graphics, and the DeviXpert name and logo are owned by DeviXpert or its licensors and may not be copied, reproduced, or reused without our written permission. Deliverables created for a client under a specific service agreement (e.g. a website, ad creative, or automation workflow) are governed by the intellectual-property terms in that agreement, not by this Site's general Terms.
7. Confidentiality
Information you share with us through a strategy call, proposal discussion, or active engagement — including business details, credentials, and account access we need to perform our services — is treated as confidential and used only to evaluate or deliver that engagement, consistent with our Privacy Policy.
8. Third-Party Platforms & Links
Our services may involve, and the Site may reference or link to, third-party platforms we do not own or control (for example Google, Meta, GoHighLevel, Zapier, Shopify, or WordPress). We are not responsible for those platforms' availability, terms, pricing, or policies. As stated throughout our service descriptions, DeviXpert does not sell, provide, or provision GoHighLevel accounts — any GoHighLevel-related work is performed inside a client's own existing account.
9. Limitation of Liability
To the fullest extent permitted by law, DeviXpert will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Site or our services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from a paid engagement is limited to the fees you paid us for that engagement in the three months preceding the claim, except where a separate written service agreement states otherwise.
10. Indemnification
You agree to indemnify and hold DeviXpert harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or content or credentials you provide us in connection with an engagement.
11. Termination
We may suspend or restrict access to the Site at our discretion, for example to address misuse or a security concern. Termination of a specific paid engagement is governed by that engagement's own proposal or service agreement.
12. Governing Law
These Terms are governed by the laws applicable in the jurisdictions in which DeviXpert operates, without regard to conflict-of-law principles. Any dispute arising from these Terms or an engagement with us will first be addressed through good-faith direct discussion between the parties.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or for legal, operational, or regulatory reasons. We will post the updated version on this page with a revised "Last updated" date. Continued use of the Site after an update constitutes acceptance of the revised Terms.
